Terms of Service – NeorniPharma
Overview
Welcome to NeorniPharma. The terms “we”, “us” and “our” refer to Neornivet BV (VAT BE1026.203.184), operating under the trade name NeorniPharma. We operate this webshop and its related services (the “Services”) via the Shopify platform.
By accessing or using our Services, you agree to these Terms of Service and our Privacy Policy (link). If you do not agree, please refrain from using the Services.
Article 1 – Access and account
You declare that you are of legal age under the applicable law. To use certain Services, you may be required to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account.
Article 2 – Products and information
We make every effort to present product information as accurately as possible. Images and colours may vary depending on your screen settings. Product descriptions may be modified at any time. We reserve the right to limit or discontinue products.
Important: the products offered are nutritional supplements for animals and not veterinary medicinal products. They are not intended for the diagnosis, treatment or cure of diseases. In the event of health issues, always consult a licensed veterinarian.
Article 3 – Orders
Placing an order constitutes an offer to purchase. A contract is formed only after our confirmation and successful processing of payment. We may refuse or cancel an order in the event of errors or inaccuracies. This does not affect your statutory right of withdrawal (see return policy).
Returns and withdrawals are handled exclusively in accordance with our Return and Refund Policy (link).
Orders are intended for personal or household use only and not for commercial resale or export.
Article 4 – Prices and payment
Prices apply at the time of ordering and are confirmed by email. Unless stated otherwise, prices exclude shipping and any additional costs. You undertake to provide accurate and up-to-date payment and billing information.
Article 5 – Shipping and delivery
Delivery times are indicative. Delays caused by carriers or force majeure do not give rise to compensation. The risk of loss or damage transfers to you upon delivery of the goods to you.
Article 6 – Intellectual property
All content of the Services is protected by applicable intellectual property laws and remains the property of Neornivet BV or its licensors. Use is permitted solely for personal, non-commercial purposes, unless prior written consent has been obtained.
Article 7 – Optional tools and third parties
We may provide access to tools or links from third parties. Use of such tools is at your own risk. We are not liable for the content, operation or damage arising from the use of third-party services.
Article 8 – Relationship with Shopify
Our webshop is technically supported by Shopify. All transactions are conducted directly with Neornivet BV. Shopify is not a party to the sales contract.
Article 9 – Privacy
Personal data are processed in accordance with our Privacy Policy (link) and, where applicable, Shopify’s privacy policy.
Article 10 – Feedback
By submitting feedback, you grant us a worldwide, royalty-free licence to use it for the improvement and promotion of the Services, without any obligation of compensation.
Article 11 – Errors and inaccuracies
We reserve the right to correct errors and to amend or update information. Orders may be cancelled in the event of material errors.
Article 12 – Prohibited use
You undertake to use the Services lawfully and not to engage in conduct that may harm the Services, other users or third parties. In case of breach, we may suspend or terminate your access.
Article 13 – Termination
We may terminate your access to the Services. Provisions which by their nature should survive termination shall remain in effect.
Article 14 – Disclaimer of warranties
To the extent permitted by law, the Services and products are provided “as is” and “as available”, without implied warranties. Nothing in these terms affects mandatory consumer rights.
Article 15 – Limitation of liability
To the extent permitted by law, Neornivet BV shall not be liable for indirect or consequential damages. This limitation does not apply where mandatory law provides otherwise.
Article 16 – Indemnification
You agree to indemnify Neornivet BV against third-party claims arising from your breach of these terms or unlawful use of the Services.
Article 17 – Severability
If any provision is found unenforceable, the validity of the remaining provisions shall not be affected.
Article 18 – Entire agreement
These terms constitute the entire agreement between you and us regarding the Services.
Article 19 – Assignment
You may not assign your rights or obligations without our consent. We may do so.
Article 20 – Governing law and jurisdiction
These Terms of Service are governed by Belgian law. Disputes fall under the jurisdiction of the Belgian courts, without prejudice to mandatory consumer protection rules.
Article 21 – Amendments
We may amend these terms. The most recent version is always available on this page. Continued use after changes constitutes acceptance.
